Special Needs Children

Special needs children receive far more consideration from the courts in today’s environment.

The Divorce Act provides that, depending upon the circumstances, special needs children may
require support as long as their special needs impacts upon their ability to withdraw from their
parents charge.

The issues in section 24 of the Children’s Law Reform Act are as relevant for special needs
children as for any other children. Parents should well spend extra time in the preparation of any
parenting plan to be put before the courts. As well, professionals who administer the children’s
needs would be in a good position to provide the court with the information to make
determinations about custody and access.
